Personal Licence Lincolnshire

Selling Alcohol in Lincolnshire

Applying for your Personal Licence to sell alcohol in Lincon or any where in Lincolnshie is easy with us! We hold regular licensing law cousres for the Award for Personal Licence Holders (APLH) licensing qualification every month in the City of Lincoln. Our one day course will teach you all you need to know about the licensing Act 2003 for England & Wales. At the end of the APLH training course you will sit a multiple choice examination of 40 questions. Once achieved you then may apply to your local licensing authority in Lincolnshire these are listed below;

A personal licence will allow you to sell or authorise the sale of alcohol under a premises licence or temporary event notice. It will also allow you to become the Licensee, this is now know as a Designated Premises Supervisor (DPS). The Designated Premises Supervisor is the individual named on the premises licence as the main point of contact to the Police and other Responsible Authorities within a Local Council area. Applying for a licence to sell alcohol in Scotland

HOW TO GET YOUR LICENCE IN SCOTLAND

Are you looking to gain a licence to sell alcohol in Scotland? Then you need to take a one day licensing law course for the Scottish Certificate for Personal Licence Holders (SCPLH) Level 5.

We hold regular liquor licensing courses throughout Scotland at Edinburgh, Glasgow, Dundee, Aberdeen, Inverness and Ayr.

The one day training course will give you an in-depth knowledge of the new Licensing Act for Scotland. At the end of the training day your are required to sit a simple 40 question multiple choice examination on the Licensing Act for Scotland.

Once you have achieved your examination and received your SCPLH certificate you will then need to apply to your local Licensing Board at your local council offices for your Scottish Licence to sell alcohol.

In Scotland you have to be a fit and proper person to hold a licence to sell or authorise the sell of alcohol from licensed premises, therefore the Police will be informed by the Licensing Board of your application and conduct a (PNC) Police National Computer check on each individual applying for a licence.

You will normally be contacted directly by the police and asked to attend an interview or in some cases you may be interview over the telephone mainly to ensure you have full knowledge of the Scottish Licensing Act and to discuss any concerns the Police may have.

Once the Police and Licensing Board are satisfied your Personal Licence will be granted.

Your Personal Licence is issued in two parts;

  1. A photo-card licence, and;
  2. A paper counterpart  
Notes for Applications for Personal Licences

1. A personal licence application or a personal licence renewal application must be in the statutory form and accompanied by;
(i) evidence that the applicant possesses a licensing qualification; and
(ii) two photographs of the applicant which comply with paragraph (2) and one of which has a statement on it in accordance with paragraph (3).

2. The two photographs of the applicant must;
(b) measure 45 millimetres by 35 millimetres;
(c) be on photographic paper;
(d) be taken against a light background; and
(e) show the full face of the applicant, without the applicant wearing sunglasses or any head covering (unless the applicant wears such a covering on account of a religious belief).

3.   One photograph of the applicant must have on the back of it a statement by a person appearing to the Licensing Board to be a person of standing in the community,  with the words “I certify that this is a true likeness of (name of applicant)”, followed by the full name of the person endorsing the photograph.

Once issued a Scottish personal licence is valid for 10 years, however under the Act you may have an obligation to re-train every 5 years as the Licensing Act may be reformed. 

A personal licence will allow you to sell and authorise the sale of liquor under a premises Liquor Licence. A personal licence will also allow the holder to apply to be a Premises Manager named as the main point of contact to all Responsible Authorities in a given area.

All staff working on licensed premises must also of had a minimum of 2 hours training on their responsibilities and duties when engaged in the sale of alcohol. Gloucester pubs pass underage drinkers test!

Underage drinkers are out of luck in Gloucester as 19 pubs, clubs and off licence premises successfully passed an underage test purchase campaign. The police launched operation "Nite-X it involved 3 teams of Special Constables tackling underage drinking, binge drinking and other alcohol related disorder. Sergeant Liz Lovell of Gloucester Constabulary said,"there were some good results especially the fact that none of the premises tested served underage drinkers. This is the first time since the operation has been running that there has been a 100% pass rate".

A spokesperson for Personal Licence Training said, " We  intend to back Gloucester Police and Trading Standards and will assist in introducing a Challenge 25 policy to all Gloucester Pubs. We have rolled the Challenge 25 policy out to all publicans in Worcestershire and Warwickshire distributing well over 8,000 Challenge 25 posters and intend to do the same in Gloucestershire. If you are currently unemployed you may be eligible for funding from the Department of Work and Pensions (DWP) to help you gain your personal alcohol licence.

A Personal Alcohol Licence will allow an individual to sell and authorise the sale of alcohol from licensed retail premises such as;

Furniture shop gives away free booze!



Furniture shop in Farnham, Surrey gives away free booze to its customers. Local police and councilors are powerless to act because licensing laws only apply to premises where alcohol is being sold by retail.

Locals are flocking to the Innsatiable bar and furniture shop in Farnham which opened its doors last month. Drinks are given away free to customers but they need to obtain a beer mat at a cost of £2.75 to avoid damaging the furniture. Mr Atkinson the shop’s owner told the Morning Advertiser newspaper: “The bee in everyone’s bonnet is that we are offering free alcoholic drinks from a free bar. Everyone who comes in thinks it is a great idea — my staff are very welcoming.”

A spokesman for Waverley council said: “Should information come to light that the Licensing Act 2003 is being breached Waverley borough council will take appropriate action.”

Don Laight, landlord of The Jolly Sailor and chairman of the local Pubwatch voluntary group which promotes safer drinking, said: “This guy has found a loophole in the licensing laws and there’s not much anyone can do about it at the moment.

“It’s really affecting some of the pubs in the centre of the town because there’s no way they can compete, and it’s going to get worse when the students come back to university. As you can imagine they’ll be around it like it’s a honey pot.”

Mr Atkinson plans to open branches in Winchester and Guildford soon and 13 other outlets next year. Dean Carr from the PLT Licensing team said “It will be interesting to see the outcome of this case and what course of action the local council and responsible authorities will take as effectively the beer mats are beer tokens”.

Duties of a Personal Licence Holder

A Personal Licence will allow the holder to sell alcohol by retail or authorise the sale of alcohol from a licensed premise such as;
  • Public House
  • Off Licence
  • Supermarket
  • Night Club
  • Hotel
  • Guest House
  • Casino
  • Temporary Event
  • Any premise where alcohol is sold for profit
A personal licence will also allow the holder to become the designated premises supervisor (DPS). There a currently two types of personal licence in force in the United Kingdom. A Scottish personal licence for Scotland which allow the retail sale of alcohol anywhere in Scotland, and a personal licence for England and Wales. A personal licence will be granted by a local Council's Licensing Authority or in Scotland a Licensing Board.
When you apply to a Licensing Authority or Licensing Board for a Personal Licence, your local Licensing Authority will license you to sell alcohol. The license issued is then valid for 10 years from the date of grant, renewal of a personal licence is back to the issuing Licensing Authority or Licensing Board.
A Personal Licence holder has a list of duties and responsibilities they must attend to, these are as follows;
Duties of a Personal Licence Holder in England and Wales
1. Change of Address
You must as soon as reasonably practical notify the Licensing Authority of any change to your name or address as stated in your personal Licence. Your licence must be returned with the notification and a new licence will be issued.
A fee of £10.50 is payable.
Note: Once granted, the issuing Council's Licensing Authority remains the relevant Licensing authority even though you may move out of the area or take employment elsewhere in England or Wales, this will apply for the renewal of your licence. Failure to notify a change of address is an offence. Please note a person commits an offence if he fails, without reasonable excuse, to comply with this section.
2. Duty to produce licence
a) The Licensing Authority is required to update your personal licence whenever a change is required as a result of a notification from you or a court.
The licensing Authority may require you to produce your licence
within a period of 14 days. Failure to provide your licence to the Licensing Authority is an offence.
b) You must provide your personal licence for examination by a Constable or an authorised officer of the Licensing Authority whenever you are engaged in the supply or sale of alcohol. Failure to produce the licence for examination is an offence.
3. Theft, loss, etc of personal licence Where your personal licence has been lost, stolen, damaged or destroyed, you may apply to the licensing authority for a copy of the licence. A fee of £10.50 is payable for this service. If your licence is lost or stolen you must report it to the police.
4. Surrender of Licence
Should you wish to surrender your personal licence you must return the licence to the Licensing Authority (Local Council) together with a signed letter stating that you wish to surrender the licence.
5. Convictions after Grant of Licence
a) If you appear in court on a charge relating to a relevant offence, you must produce your licence to the court. If you cannot produce your licence, you must notify the court that you are a personal licence holder.
b) If you are informed that you have been granted a personal licence after
your first appearance in court, you must inform the court at the next hearing
that you are now a personal licence holder.
c) Where you have produced your licence to the court, or notified them of its existence, you must also notify the court at your next appearance, if any of the following events have occurred.
  • You have made or withdrawn an application for renewal of your personal licence.
  • You have surrendered your personal licence
  • Your personal licence has been renewed
  • Your personal licence has been revoked
d) If you are convicted of a relevant offence the court may order the forfeiture or suspension of your licence. The court will notify the Licensing Authority.
e) You are required to notify this Licensing Authority of any convictions for a relevant offence. The notification must provide the nature and date of conviction and the sentence imposed. Your personal licence must be returned with the notification. Failure to make this notification is an offence.
Duties of a Personal Licence Holder in Scotland
Changes in name or address
The holder of the licence is required by section 88 of the Act to notify the Licensing Board of any changes of name or address. These changes should be recorded by the Licensing Board and the procedure for this is set out in section 89 of the Act
2. Duty to produce licence
A Scottish Personal Licence Holder must produce his/her personal licence to a police officer or Licensing Standards Officer from a Licensing Board.
3. Theft, loss, etc of personal licence
A personal licence holder should inform the Licensing Board of any theft or loss of a personal licence.
5. Convictions after Grant of Licence
Under section 75 of the Licensing(Scotland)Act 2005; applicants are under a duty to notify the Licensing Board should they be convicted of a relevant or foreign offence during the application period. Should Boards receive such notifications they must suspend consideration of the application and notify the police of the conviction seeking either confirmation of the relevant or foreign offence or that no relevant or foreign offence has been committed. At this time should a relevant or foreign offence have been committed the chief constable may recommend refusal of the application. Licensing Boards must resume consideration of the application process and, in these circumstances, take the chief constable's recommendations into consideration when determining the application.
Licensing qualifications/training
176. Section 74(3) of the Act requires that to be eligible for a personal licence an applicant must hold a licensing qualification. Furthermore personal licence holders are required to undertake mandatory training every 5 years as set out in section 87 of the Act. Section 91 of the Act provides a power for Ministers to set out in regulations which qualifications are applicable.
Offences relating to drunkenness
It's a criminal offence for a personal licence holder to be drunk while on duty on licensed premises.
